The Field Sobriety Test and Chemical Tests

A field sobriety test will be conducted on the driver once a law enforcement officer suspects the he or she is intoxicated.  This will be administered right after the law enforcement officer stops the vehicle and asks the driver for a chemical test in order to determine if he or she is indeed intoxicated with alcohol, drugs or both.

The field sobriety test involves several tasks that the law enforcement officer will administer to the driver to see his or her cognitive and physical abilities.  Among the very common tasks in a field sobriety test are the following:

  • requesting the driver to stand from heel to toe
  • instructing the driver to walk in a straight line
  • the horizontal gaze nystagmus which is also known as the eye and penlight test
  • recitation of the alphabet in a backward order.

Breathalyzer can also be used in order to determine the driver’s blood-alcohol concentration (BAC).  Through this device, the driver’s toxicity level on the alcohol or drugs consumed will be determined and can stand as strong evidence of DUI against the driver.  Other chemical tests may also be conducted in a hospital wherein urine and blood tests are carried out to determine the level of toxicity on the driver.  There are several states in the country which allows the driver who is suspected of DUI to choose which type of chemical test he or she wishes in order to determine his toxicity level.
